Part I — Terms of Use
1. Agreement and scope
These Terms of Use (“Terms”) govern access to and use of www.naprawde.store and any related pages, features, customer
accounts, communications, and online services operated by NAPRAWDE, LLC under the NA✽PRAWDE® brand (collectively, the
“Site”). “NAPRAWDE,” “we,” “us,” and “our” mean NAPRAWDE, LLC. “You” means the person accessing or using the Site.
By using the Site, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference,
including the Privacy Notice and the return, shipping, and other checkout disclosures displayed on the Site. If you do not agree,
do not use the Site. Additional terms presented for a feature, promotion, subscription, or product become part of these Terms
for that feature or transaction. If additional terms conflict with these Terms, the more specific terms control for that subject.
The Site offers clothing, accessories, and related merchandise for men and women. Product availability, features, and service
areas may change.
2. Eligibility and electronic consent
You must be at least 18 years old or the age of legal majority where you live to create an account or enter into a purchase
contract. A minor may browse or purchase only with the involvement and consent of a parent or legal guardian who accepts
responsibility for the transaction.
You consent to receive transaction records, disclosures, order confirmations, and notices electronically. You may retain copies
by printing or saving them. You remain responsible for keeping your contact information current. Marketing communications are
governed by your choices and applicable law; consent to marketing is not a condition of purchase.
3. Accounts and user responsibilities
If accounts are offered, you agree to:
• provide accurate, current, and complete information;
• keep your password and authentication methods confidential;
• promptly update account information and notify us of suspected unauthorized access;
• use only payment methods you are authorized to use; and
• comply with these Terms and applicable law.
You are responsible for activity under your account to the extent permitted by law. Do not share credentials or use another
person’s account without authorization. We may require reasonable verification before processing a sensitive account request.
We may suspend or restrict an account when reasonably necessary to investigate fraud, protect customers or the Site, comply
with law, or address a material violation. We will not use this provision to limit non-waivable consumer rights.
4. Acceptable use
You may use the Site only for lawful personal shopping and genuine business interactions with NAPRAWDE. You may not:
• interfere with Site security, availability, or operation;
• introduce malware, scrape at unreasonable volume, bypass access controls, or probe for vulnerabilities without written
authorization;
• impersonate another person or misrepresent your authority;
• use bots to hoard inventory, manipulate promotions, or make fraudulent purchases;
• submit unlawful, deceptive, abusive, infringing, or privacy-invasive content;
• resell Site access or copy substantial Site content to build a competing service; or
• use the Site in violation of export, sanctions, consumer-protection, or other applicable law.
We may use proportionate technical and legal measures to prevent misuse.
5. Product information, availability, and orders
We aim to describe products, colors, materials, dimensions, care instructions, origin, and prices accurately. Screen settings
and manufacturing variations can affect appearance. Images are illustrative of the product offered but do not guarantee an
exact color match. Product descriptions are not warranties beyond any express warranty stated in writing.
An order is an offer to buy. Receipt of an order confirmation means we received the order; it does not necessarily mean we
accepted it. We may accept, reject, limit, or cancel an order for legitimate reasons, including unavailability, pricing or
description errors, suspected fraud, shipping restrictions, or legal compliance. If we cancel after payment is captured, we will
issue a refund to the original payment method unless applicable law requires another remedy.
Prices, promotions, and availability may change before an order is submitted. For goods or services offered online, the
advertised, displayed, or offered price will include all mandatory fees or charges required to complete the transaction, except
government-imposed taxes or fees, reasonable charges we actually incur to ship goods or provide services, and any other
charge that Oregon law permits to be separately disclosed. Any permitted selection- or distance-based service fee will be
disclosed prominently before you agree to pay. You are responsible only for charges clearly disclosed before purchase. We may
limit quantities per person, household, account, payment method, or order.
6. Content and intellectual property
The Site and its text, photographs, graphics, designs, product presentation, software, selection, arrangement, and other
content are owned by or licensed to NAPRAWDE and are protected by U.S. and other intellectual-property laws. NA✽PRAWDE®,
NAPRAWDE, the associated logos, and trade dress are trademarks or service marks of NAPRAWDE, LLC or its licensors. No
license to use any mark is granted except as expressly stated.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal,
noncommercial shopping. You may not reproduce, modify, distribute, publicly display, sell, license, reverse engineer, or exploit
Site content except as permitted by law or with prior written permission.
If you submit a review, photograph, comment, suggestion, or other material (“User Content”), you retain ownership of your
original content. You grant NAPRAWDE a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce,
format, display, and distribute that User Content solely to operate, promote, improve, and protect the Site and NAPRAWDE
products. The license ends when the content is deleted from our active systems, except for reasonable backup retention, legal
records, and content already used in materials created with your permission. You represent that you have the rights needed to
submit the content and grant this license.
Unsolicited product, campaign, or design ideas are not accepted in confidence. Do not send confidential ideas unless we have
signed a separate agreement.
7. Copyright and rights complaints
If you believe material on the Site infringes your copyright, send a written notice to info@na-prawde.com with:
• your physical or electronic signature;
• identification of the copyrighted work claimed to be infringed;
• identification and location of the material to be removed;
• your name, mailing address, telephone number, and email address;
• a statement of good-faith belief that the disputed use is not authorized; and
• a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner.
A person whose content was removed may submit a counter-notice identifying the removed material and its prior location,
consenting to jurisdiction as required by 17 U.S.C. § 512(g), accepting service of process, and stating under penalty of perjury a
good-faith belief that removal resulted from mistake or misidentification. We may forward notices and counter-notices to the
affected parties. Knowingly material misrepresentations may create liability under law.
If the Site hosts user content and NAPRAWDE seeks Digital Millennium Copyright Act safe-harbor protection, NAPRAWDE must
designate and maintain an agent with the U.S. Copyright Office and publish the same agent details on the Site. The public notice
must include the designated agent’s name, organization, mailing address, telephone number, and email address. The launch
checklist treats this as a required item rather than inventing missing contact details.
Trademark, publicity, counterfeit, or other rights complaints should identify the right, the challenged material, its Site location,
the complainant’s contact information, and supporting documentation. We may request verification and take appropriate
action.
8. AI assistant and responsible use
If NAPRAWDE offers an artificial intelligence (“AI”) shopping assistant, chatbot, recommendation tool, or generated content,
the feature is provided for convenience. AI output may be incomplete, inaccurate, or outdated. Verify important details—
especially price, availability, sizing, materials, care, shipping, returns, and promotions—against the product page, checkout,
and human customer support.
Do not submit payment-card numbers, government identifiers, account passwords, health information, or other highly sensitive
data to an AI feature. Do not use an AI feature to generate unlawful, abusive, deceptive, infringing, discriminatory, or harmful
content, or to bypass Site controls. AI interactions may be processed by service providers and reviewed for safety, quality, fraud
prevention, or customer support as described in the Privacy Notice.
An AI response does not modify an order, issue a refund, create a warranty, or bind NAPRAWDE unless confirmed through an
authorized transaction or by an authorized representative. NAPRAWDE will not rely solely on an AI tool to make a decision
producing legal or similarly significant effects about a customer. Human support is available at info@na-prawde.com.
9. Community guidelines
If reviews, comments, customer galleries, or other public features are enabled, contributions must be based on genuine
experience and must not contain:
• harassment, threats, hate, or targeted abuse;
• unlawful, sexually exploitative, or violent content;
• private or sensitive information about another person;
• malware, spam, undisclosed advertising, or manipulation;
• counterfeit claims, deceptive endorsements, or impersonation; or
• material that infringes intellectual property, publicity, or other rights.
Disclose any material connection to NAPRAWDE when posting an endorsement, including a free product, discount, payment,
employment, or family relationship. We may moderate, label, restrict, or remove content in good faith to enforce these
standards, protect users, or comply with law. We do not promise to pre-screen every contribution. Reporting a concern does not
guarantee a particular outcome.
10. Purchases, payments, shipping, returns, and refunds
Payment authorization
By submitting an order, you authorize NAPRAWDE and its payment processor to charge the displayed total to your selected
method. Payment methods, currencies, installment options, and processor terms are shown at checkout. We do not control a
bank’s authorization holds, exchange rates, or fees. Contact us promptly about a suspected billing error; this does not limit
rights you may have with your card issuer or financial institution.
Shipping and delivery
Available destinations, shipping methods, estimated timeframes, and charges are displayed at checkout or in the Shipping
Policy. Delivery estimates are not guarantees unless expressly stated. Risk of loss and title transfer as provided by applicable
law and the stated shipping terms.
NAPRAWDE will maintain a reasonable basis for advertised shipment times. If we cannot ship within the promised time—or
within the period required by law when no time is stated—we will provide any required delay notice and cancellation option and
will issue a prompt refund for unshipped merchandise when required. International customers are responsible for disclosed
duties, taxes, brokerage, and import restrictions unless checkout states otherwise.
Returns and exchanges
Return eligibility, request deadlines, item condition, proof-of-purchase requirements, return-shipping responsibility, exclusions,
exchange availability, and any restocking charge are governed by the Return Policy displayed before checkout. Applicable law
controls if it provides greater rights. Products marked final sale are not returnable except where required by law or where
defective, damaged, or materially different from the order.
Owner action: Do not publish this section without a complete Return Policy stating the actual return window and process. A
customer should receive a return authorization, if required, before sending merchandise. Refunds are issued after receipt
and inspection, or earlier when law requires, to the original payment method unless another lawful method is agreed.
Original shipping fees are refundable only when the posted policy or law requires.
Damaged, defective, or incorrect items
Contact info@na-prawde.com promptly with the order number, a description, and reasonable supporting photographs when
appropriate. We may offer replacement, repair, refund, or another remedy consistent with the posted policy and applicable law.
Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.
Promotions and gift value
Promotions are subject to stated dates, eligibility, exclusions, and redemption limits. Promotions have no cash value unless
required by law and may not be combined unless stated. Gift cards, store credits, loyalty value, and promotional credits, if
offered, are governed by their disclosed terms and applicable federal and state law. For gift cards sold to Oregon consumers,
NAPRAWDE will not impose an expiration date, time-based reduction in value, inactivity fee, maintenance fee, or service fee
except where a lawful exception applies. When Oregon law requires it, an eligible cardholder may redeem a remaining balance
of less than US$5 after at least one purchase; statutory exceptions may apply, including to certain promotional cards and cards
redeemed to an online account.
11. Creator, affiliate, and payout programs
“Writer Earnings and Payouts” does not apply to NAPRAWDE’s current retail model. The Site is not a publishing platform and
these Terms do not promise earnings or payouts to writers, creators, affiliates, ambassadors, models, or other contributors.
If NAPRAWDE later offers a creator, affiliate, referral, consignment, or marketplace program, participation will require separate
written program terms covering eligibility, tracking, commissions, returns and chargebacks, taxes, payment timing, disclosures,
content rights, termination, and dispute handling. No payment obligation arises without those separate terms.
12. Third-party services and links
The Site may rely on third parties for hosting, checkout, payments, shipping, analytics, communications, fraud prevention,
social features, or other functions. Their services and privacy practices may be governed by their own terms. A third-party link
does not imply endorsement. NAPRAWDE is not responsible for third-party content or services, but this clause does not limit
responsibility that applicable law places on NAPRAWDE for its vendors or transactions.
13. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” NAPRAWDE disclaims
implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except to the extent an
express written warranty or applicable law provides otherwise. We do not warrant uninterrupted, error-free, or completely
secure Site operation.
This disclaimer does not apply where prohibited and does not limit non-waivable warranties, product-liability obligations, or
consumer remedies. Some states do not permit certain exclusions, so they may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, NAPRAWDE and its members, officers, employees, agents, and service providers will not
be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits or data, arising from the
Site or these Terms, even if advised of the possibility.
To the fullest extent permitted by law, aggregate liability for claims relating to a purchase will not exceed the amount paid for the
product giving rise to the claim, and aggregate liability for other Site-related claims will not exceed US$100. These limits do not
apply to fraud, willful misconduct, gross negligence where it cannot be limited, personal injury caused by negligence, statutory
damages that cannot be waived, or other liability that law prohibits limiting. Some jurisdictions do not allow certain limitations.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NAPRAWDE and its personnel from third-
party claims arising from your unlawful misuse of the Site, your User Content, or your material breach of these Terms. This
obligation does not apply to claims caused by NAPRAWDE’s own unlawful conduct and does not require a consumer to
indemnify NAPRAWDE for ordinary use of purchased products.
Oregon & U.S. Website Policy S
16. Suspension and termination
You may stop using the Site at any time and may request account closure. We may suspend or terminate access for material or
repeated violations, fraud, security risk, legal requirements, or discontinuation of the Site. Where practical and lawful, we will
provide notice. Provisions that by their nature should survive—such as payment obligations, intellectual-property protections,
disclaimers, liability limits, and dispute terms—will survive.
